Terms & conditions
The basis on which THAIVIA is offered.
Terms for everyone who uses the portal, with additional terms for property seekers, property owners, and the agents, developers and partners who market property with us.
Private prototype. Listings and enquiries are test content, no transaction or fee obligation is created, and these working terms must be reviewed before public launch.
Version 1.0 · 20 October 2026
Part A · Everyone who uses THAIVIA
This part applies to every visitor, member and partner. The parts that follow add terms for particular roles: property seekers, property owners, and agents, developers and other partners.
1. About these terms and who we are
THAIVIA is the property portal owned and developed by PropertyStore Thailand. In these terms "we", "us" and "THAIVIA" mean PropertyStore Thailand, and "you" means the person using the portal, whether as a visitor, a member, a property seeker, a property owner, an agent, a developer or another partner.
These terms and conditions govern your access to and use of the portal, including property search, listing pages, editorial guides, saved properties, matching, enquiry forms, contact forms and the partner dashboard.
By using the portal you agree to these terms. If you do not agree with them, do not use the portal.
Our privacy notice and cookie notice form part of these terms and should be read with them.
We may publish additional terms for a specific feature. Where those terms conflict with these, the feature terms apply to that feature.
2. Who may use THAIVIA
You may use the portal only if you can enter into a binding agreement and are at least 18 years old. Property transactions require legal capacity, and the portal is not intended for children.
If you use the portal for a business, agency, developer or other organisation, you confirm that you are authorised to accept these terms on that organisation’s behalf, and "you" includes that organisation.
- The portal is designed for property in Thailand. It is published in English, and features or information may not be suitable or available where you are.
- We may refuse, suspend or withdraw access to the portal or to any feature at any time, including where we believe these terms have been breached or where we are required to do so by law.
3. Accounts, sign-in and security
Accounts are created through the platform’s sign-in service, using an email address and password or a supported third-party sign-in. Email verification and password recovery messages are genuine transactional messages.
- Keep your password, verification codes and sign-in access private. Do not share an account or let anyone else use it.
- Give accurate account details and keep them up to date. One account per person or organisation unless we agree otherwise in writing.
- Tell us promptly if you believe your account has been used without your authority.
- You are responsible for activity carried out through your account while it is under your control.
Creating an account does not approve an agency, verify a developer, confirm ownership of a property, publish inventory or create any commercial relationship with THAIVIA.
We may suspend or close an account, or require a password reset, where we believe it is necessary for security, accuracy or compliance.
4. Private prototype: test content and limited availability
THAIVIA is currently a private prototype used for testing. Every listing is sample or test content, including where real project information has been supplied for testing. A project appearing on the portal does not confirm that a unit is available, that a price is current, or that THAIVIA holds a live instruction to market the property.
- Property enquiry, contact, requirements and partner forms save test records to the prototype enquiry log. No external message is sent, no viewing is confirmed and no property is reserved.
- Emails and data sent to partners, and any email delivery of leads, may not yet be configured. Leads are currently available to the relevant partner account and to portal administrators inside the portal.
- Features may be incomplete, may change without notice, may be reset for testing, and may not work as described. Use sample contact details in test forms.
5. Property information, prices and imagery
Listing content is supplied by property owners, developers, agents or our own test data. Prices, specifications, usable and land areas, bedroom and bathroom counts, amenities, locations and addresses are illustrative or unverified unless expressly stated otherwise.
Illustrative images, renders, plans and photographs do not necessarily represent the actual property, its current condition, its views or its finishes. Sample listings are labelled in the interface and carry no verification guarantee.
Project details, price guidance, availability and completion targets may change at any time and require confirmation from an authorised source before you rely on them.
Measurements are approximate and should not be treated as a survey.
6. No offer, no reservation and no professional advice
Content on the portal is published to help you explore property. Nothing on the portal is an offer, an invitation to treat, a reservation, a contract, a title confirmation or a commitment by anyone to sell, let or buy a property.
We do not provide legal, tax, accounting, financial, investment, valuation, surveying, engineering or immigration advice, and nothing on the portal should be read as such advice. Editorial guides and AI-written notes are general information only and may be out of date or incomplete.
No transaction can be concluded through this prototype. Always take independent professional advice and verify details directly before committing to a property or paying any money.
7. Enquiries, viewings and message records
When you submit an enquiry, contact form, viewing request or requirements form, we record the details you provide. In the prototype these are stored as test records; no external message is sent and no appointment is confirmed.
Once delivery is enabled, an enquiry submitted against a listing is passed to the developer or agent shown on that listing so they can respond to you directly. It may also be reviewed by our administrators for support, quality control and dispute handling.
- Submit only the information needed for your enquiry, and avoid sensitive personal, financial or identity documents.
- The developer or agent shown on the listing is responsible for responding to you. THAIVIA does not guarantee a response, a viewing or an outcome.
- Do not use enquiry forms for anything unlawful, for bulk or automated messages, or to send advertising or promotions.
8. Acceptable use
You agree not to do any of the following, and not to allow anyone else to do them through your access:
- submit content that is unlawful, misleading, defamatory, discriminatory, obscene or infringing, or that misrepresents who you are or what you are entitled to offer
- copy, scrape, harvest or systematically extract listings, contact details, images, editorial content or AI-generated text, or use automated tools to access the portal without our written permission
- attempt to access records, accounts or areas you are not entitled to see, or to bypass access controls or permissions
- test, probe or breach the security of the portal, or interfere with its operation, other than a security assessment we have authorised in writing
- impersonate another person, agency, developer or property owner, or misrepresent your connection to a property
- upload or transmit software, links or code intended to damage, disrupt or gain unauthorised access to any system
- use enquiry or lead information to market unrelated goods or services, or to build a competing database
We may investigate suspected breaches, remove content and suspend access, and we may report conduct to the relevant authorities where we consider it appropriate.
9. Your submissions and content
You keep ownership of the content you submit, such as listing details, photographs, renders, plans, text and your organisation’s name and marks.
By submitting content you grant THAIVIA a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, format, resize, translate, display and promote that content within the portal and in related marketing of the portal, for as long as it appears on the portal and for a reasonable period afterwards for backups and records.
You confirm that you have all rights, permissions and consents needed to submit the content, including the consent of any person shown in a photograph, the property owner’s authority, and any necessary permission to use a project name, logo, render or plan.
You confirm that the content is accurate and not misleading, and that submitting it does not breach any law, contract or duty of confidence.
We may format, label, translate, crop, badge or shorten content, mark content as sample or test content, and edit or remove content that we consider inaccurate, misleading, unlawful, duplicated or contrary to these terms.
10. Third-party content and links
The portal includes summaries of and links to articles published by third parties, along with links to other external sites. Those publications and sites are not controlled by us, and their own terms and privacy notices apply.
We do not endorse, verify or take responsibility for third-party content, offers, statements or services reached through the portal.
11. Availability, changes and suspension
The portal is provided as a working prototype on an "as available" basis. We may add, change, withdraw or suspend features, parts of the portal or the whole portal without notice, including for maintenance, testing or legal reasons.
We do not guarantee that the portal will be uninterrupted, secure, error-free or that content will be complete, current or accurate. You should keep your own records of anything important to you.
We may set limits on usage, storage or the number of records, and may remove content we consider excessive or abusive.
12. Intellectual property and brand
The THAIVIA name, logotype, page layouts, interface design, code, editorial content, guides and original imagery are owned by PropertyStore Thailand or its licensors and are protected by intellectual property law.
You may use the portal as intended, and you may share links to public pages and take reasonable extracts for personal, non-commercial reference with clear attribution to THAIVIA. No other right or licence is granted.
You may not copy, modify, distribute, sell, sublicense, frame, mirror or create derivative works from the portal or its content, or use THAIVIA’s name or marks, without our prior written permission.
Partner names, logos, photographs and project brands remain the property of their owners and are displayed with permission given to us by the relevant partner.
13. Complaints, corrections and contact
If you believe content on the portal is inaccurate, misleading, infringing, defamatory or unlawful, contact us with the listing reference or page, a description of the issue and the correction you are seeking.
We will review the request and may correct, label, annotate or remove content, or decline the request. We may ask for evidence, such as a title deed or written authority, before changing an attribution or removing a listing.
In the prototype, contact form entries are saved as test records rather than delivered as messages, so responses and response times are not guaranteed.
Part B · Buyers, renters and property seekers
This part applies if you use THAIVIA to look for property to buy or rent, including browsing anonymously.
14. Our role in your search
THAIVIA is a property discovery and publishing platform. We are not your estate agent, broker, representative, fiduciary or adviser, and we do not act for buyers or renters.
We do not hold, receive or handle deposits, reservations, rent, purchase money or any other funds for a property transaction, and we do not provide escrow, conveyancing, title verification or property management services.
No agency, client or advisory relationship is created between you and THAIVIA by your use of the portal, by submitting an enquiry, or by our forwarding your details to a developer or agent.
15. Saved properties and matched suggestions
Saved properties are stored against your account. They are a personal shortlist only and do not reserve, hold or prioritise a property.
The "Matched for you" suggestions and the notes written with them are generated automatically, using the requirements, bookmarks and enquiries connected to your account. They are indicative, may be incomplete or inaccurate, and may change as your activity or the listings change. They are not a recommendation, a valuation or advice.
16. How your enquiry is handled
When you send an enquiry about a listing, the details you submit are passed to the developer or agent shown on that listing so they can answer you. Under the prototype these are test records and no external message is sent.
- Submit only details you are comfortable sharing with that developer or agent.
- We do not sell enquiry data, and we do not pass your details to unrelated businesses or marketing lists.
- The developer or agent shown on the listing is solely responsible for their response, their conduct and anything they offer you.
- If you do not want your details shared with the party shown on a listing, do not submit an enquiry.
17. What THAIVIA does not charge you
Using the portal is free for property seekers. We do not charge buyers or renters a fee, commission or subscription, and we take no payment through the prototype.
The developer, agent or owner you deal with may charge their own fees, deposits, taxes, transfer costs, common-area charges or service fees. Those are between you and them, must be confirmed in writing, and are not our responsibility.
Never send money to anyone who claims to act for THAIVIA. We do not request deposits or reservation payments, and any such request should be treated as fraudulent and reported to us.
18. Checks you should make before you commit
Listing content is illustrative or unverified. Before you commit to anything, satisfy yourself on at least the following, with independent professional advice where appropriate:
- that the property exists, is available and that the price, terms and incentives are current and confirmed in writing
- ownership and title, including the title document, leasehold or freehold structure, any mortgage, lease, encumbrance or dispute, and any ownership restriction or quota that applies to you
- the authority of the developer, agent or owner to offer the property, and who is entitled to receive any payment
- planning, zoning, permitted use, building and construction permits, completion and handover obligations, and any scheduled or special assessments
- the actual condition and boundaries of the property, its services, common areas, management arrangements and recurring costs
- the lease terms, deposit, notice periods, renewal rights and inventory if you are renting, and any restriction on use, subletting or short-term letting
- taxes, transfer and registration fees, and your own legal, immigration and financial position
We do not inspect, value, verify or guarantee any property, and we do not confirm that a price is fair, that a project will be completed, or that any statement made by a developer or agent is accurate.
Part C · Property owners
This part applies to owners of property who ask THAIVIA to consider, publish, change or remove a listing.
19. Asking us to consider your property
You can tell us about a property you own using the contact page or a listing-interest form. In the prototype these entries are saved as test records rather than delivered as messages.
Submitting details does not create a listing, an instruction to market, an agency appointment or any obligation on us. Publishing is at our discretion, and no listing relationship exists until a separate written agreement is signed by both sides.
We may publish listings ourselves, or through the developer or agent instructed on the property. Where a property is already marketed by a developer or agent, that party is normally the attributed contact for the listing.
20. Authority, evidence and accuracy
- You must own the property or be authorised in writing by the owner to market it, and you must be able to show that authority if we ask.
- We may ask for reasonable evidence, such as a title document, a project brochure, a company document or a signed authority, before publishing, changing an attribution or removing a listing.
- Information you give us must be accurate, complete and not misleading, including price, area, bedroom and bathroom counts, land size, amenities, address, availability and any incentive.
- You must tell us promptly about anything that changes, including a sale, a completed rental, a withdrawal, a price change or a change of the party marketing the property.
You are responsible for any consequence of inaccurate or incomplete information you provide, and for claims brought by anyone who relied on it.
21. How your property appears
We format, label and position listings as we consider appropriate, may badge content as sample or test content during the prototype, and may decline, edit or remove content that we consider inaccurate, misleading, duplicated, unlawful or inconsistent with the portal.
We do not guarantee any position, prominence, ranking, appearance, exposure or duration for a listing, and search results and suggestions are produced automatically.
22. Fees for owners
No fee is charged for the prototype and nothing in these terms creates a fee obligation during it.
Free listings are planned. THAIVIA works on one flat success fee: an owner pays nothing to list, and where an agent or developer markets the property, that partner pays THAIVIA a single flat fee when a transaction completes. The rate is the same for every partner, is agreed in writing before a listing is activated, and is set out in Part D of these terms.
23. Changing, correcting or removing a listing
Contact us with the listing reference if you want a listing changed or removed. We will action reasonable requests within a reasonable time where we can identify the record and the person entitled to make the request.
Where the property is marketed by a developer or agent, we may require their confirmation, or proof of your authority, before changing an attribution or removing a listing, so that third-party instructions are respected.
We may retain records of enquiries and listing history after removal for our records, dispute handling and legal compliance, as described in our privacy notice.
24. No guarantee of interest
We do not guarantee any enquiry, viewing, offer, sale, rental or rental income. Publishing a property is not a promise that it will be seen, marketed effectively or transacted.
Part D · Agents, developers and other partners
This part applies if you hold a partner account, claim a listing, or manage listings and leads through the partner dashboard.
25. Partner accounts and the partner dashboard
Partner access is provided through a free THAIVIA account and the partner dashboard. The dashboard shows the listings recorded against your account and the enquiries submitted against those listings.
The partner dashboard is part of the prototype. Entries, statuses and records may be test content, may be reset, and email or other delivery of leads may not yet be configured.
Keep your account details, organisation name and contact information accurate and current, and monitor your account for new leads.
26. Claiming a listing by its THAIVIA reference
A listing can be recorded against a partner account by entering the THAIVIA reference shown on that listing. By claiming a listing you confirm that you are authorised to manage that property, and that the details recorded for you are accurate.
- A reference can be recorded against one account only. Claiming does not transfer ownership of the listing record, does not make you the publisher, and does not give you any exclusive right to the property.
- THAIVIA remains the publisher of the listing record and may decline a claim, release a claim, move a listing to another account, or remove the listing where there is a dispute, an incorrect attribution, a doubt about authority, a breach of these terms or a legal risk.
- If a listing you are entitled to manage is recorded against another account, or should be re-attributed, contact us rather than attempting to work around the restriction.
27. Managing your listings
In the dashboard you may keep the price and the publish state of the listings on your account up to date. Other listing fields are managed by THAIVIA during the prototype, so contact us to change details such as descriptions, images, specifications or attribution.
You are responsible for the accuracy of anything you change, and we may correct, restore or remove content that misstates a property.
28. Leads and enquiries for your listings
Enquiries submitted against a listing are visible to the account managing that listing and to THAIVIA administrators. Only the account managing a listing sees its leads in the dashboard, and leads are not sold or passed to unrelated businesses.
- Use lead information only to respond to that specific enquiry.
- Respond promptly, honestly and professionally, and within any response time agreed in writing with us.
- Do not claim, or try to access, leads belonging to a listing you do not manage.
- Tell us promptly if a lead appears to be fraudulent, abusive, duplicated or sent in error.
29. Your authority to market a property
You confirm that, for every property you claim or that appears on your account, you hold a valid instruction or authority from the owner or developer to market it, and that you will keep that authority current for as long as the listing is live.
You must comply with all laws that apply to your activity, including Thai advertising, consumer protection, land and condominium, and personal data rules, and any licensing, registration or professional requirement that applies to real estate brokerage or project marketing.
You must not offer a property you are not entitled to market, offer terms you are not authorised to offer, or present yourself as acting for a party who has not instructed you.
30. Accuracy, imagery and advertising standards
- Listing information, prices, areas, availability, completion dates, promotions and incentives must be accurate, current and not misleading, and must follow the owner’s or developer’s instructions.
- You must have the right to use every photograph, render, plan, logo, project name and description you supply, and any consent needed from people shown in an image.
- Correct mistakes, withdrawn offers and sold or rented properties promptly, and tell us if you cannot.
- Do not publish content that compares unfairly with other parties, that makes unsubstantiated claims, or that breaches third-party rights.
31. Attribution, brand and imagery
Attribution on a listing, such as the developer or agent name shown with it, is a factual statement of the party we display for that listing. It is not a partnership, endorsement, verification or recommendation by THAIVIA, and it does not replace your own compliance obligations.
You keep ownership of your own names, marks and images, and you grant us a licence to display, format, resize, crop and promote them in connection with the listing and the portal, as described in Part A.
THAIVIA’s own name, logotype and marks may not be used, in advertising or otherwise, without our prior written permission.
32. Commission structure: one flat success fee
Listing on THAIVIA is planned to be free, for developers and agents alike. THAIVIA is paid for results, through a single flat success fee. Agents do not share their commission, and developers are not charged separately for enquiries, leads or impressions.
The structure works as follows:
- One flat rate for everyone: the same percentage applies to every partner, whether you are an agent or a developer. There are no tiers, no volume bands and no separate rates for sales and rentals.
- Paid on results only: the fee becomes payable once a transaction completes, meaning a sale is completed and transferred, or a rental or lease agreement is entered into, for a property introduced through THAIVIA.
- Nothing payable for a listing: no fee is charged for registering, claiming, updating or withdrawing a listing, and no fee is charged for enquiries that do not lead to a completed transaction.
- Calculated the same way for everyone: the fee is calculated on the transaction value set out in your partner agreement, so the cost of a completed transaction is clear before you list.
- Agreed in writing before activation: your flat rate, the transaction values it applies to, the point at which it becomes payable, invoicing, settlement and any exclusivity are confirmed in a written partner agreement signed before your listings are activated. Nothing is charged before that agreement is in place.
- Invoiced after completion: THAIVIA invoices the fee after the transaction completes, and it is payable within the period set out in the agreement.
- No fee obligation in this prototype: the portal is a private prototype, so no fee, commission share or other payment is due for any listing, claim, lead or test enquiry.
We may introduce or change paid options, service levels or listing products in future, with reasonable notice to partner accounts. We will give reasonable notice before changing the flat rate or the structure, and a change will not apply retrospectively to transactions already completed.
33. Handling lead and enquiry information
Lead information is personal information about the person who enquired. You must handle it lawfully, including under the Thai Personal Data Protection Act and any other law that applies to you.
- Use it only to answer that enquiry and to provide the property information the person asked for.
- Keep it confidential and secure, share it only with those in your organisation who need it to respond, and do not sell, publish or pass it to third parties.
- Do not add anyone to a marketing list, newsletter or messaging group unless they have separately consented.
- Delete or anonymise lead information when it is no longer needed for the enquiry, and follow any retention or deletion instruction we give you.
- Tell us promptly about any suspected loss, misuse or unauthorised disclosure of lead information.
34. Suspension, reassignment and removal
We may suspend or close a partner account, release a claim, reassign a listing, remove listings, or withhold a feature where we suspect misrepresentation, lack of authority, a breach of these terms or of law, unresolved complaints, or a risk to property seekers or to the portal.
We may ask for evidence of authority, accuracy or compliance before restoring access or a listing, and we may keep records of what was published and when.
If your access is suspended, these terms continue to apply to content and lead information you already hold.
35. Partner notices
We may give notices about the portal, listings or these terms through your account email address, the dashboard, or any address you have given us. Keep your contact details current, and check your account regularly.
Part E · The company, and terms for everyone
This part sets out our role, the limits of our responsibility and the legal terms that apply to all use of the portal.
36. Our role and its limits
We operate THAIVIA as a publisher of property information and a lead-routing platform. Unless we sign a separate written agreement with you, we are not a party to any property transaction, we are not an estate agent, broker, representative or fiduciary for any user, owner, agent or developer, we do not provide property services, and we do not hold any funds or deposits.
We do not verify ownership, title, authority to sell or let, area, price, condition or legal status of any property, and we do not guarantee that content published by others is accurate, complete, lawful or current.
37. Moderation, removal and enforcement
We may review, label, edit, format, refuse, restrict or remove any content, claim, listing or account, at any time and without notice, where we consider it necessary for accuracy, quality, security, compliance with law or the protection of users or the portal.
We may investigate suspected breaches, require information from a user or partner, report suspected unlawful activity to the relevant authorities, and cooperate with law enforcement.
We may keep records of content, enquiries, claims and enforcement decisions to handle complaints and disputes, to meet legal obligations and to improve the portal.
38. Your responsibility to us (indemnity)
To the extent permitted by law, you agree to indemnify and hold PropertyStore Thailand, its officers, employees and contractors harmless against claims, demands, losses, liabilities, damages, fines and costs, including reasonable legal costs, that arise from:
- content you submit, or your use of the portal in breach of these terms or of law
- your dealings with any other user, owner, agent, developer, property seeker or third party
- a claim that your content infringes intellectual property, privacy, confidence or other rights
- for partners and owners, marketing a property without authority, misrepresenting a property, or mishandling lead information
39. Limitation of liability
The portal is a prototype and is provided on an "as is" and "as available" basis. To the extent permitted by Thai law, we exclude all warranties, conditions and representations not expressly stated in these terms, including any implied warranty of accuracy, availability, fitness for a particular purpose or non-infringement.
To the extent permitted by law, we are not liable for indirect, special, incidental, punitive or consequential loss, for loss of profit, revenue, opportunity, goodwill or anticipated savings, for loss or corruption of data, or for loss arising from reliance on content published by others, from a third party’s acts or omissions, from interrupted or unavailable service, or from any property decision you make.
Nothing in these terms limits or excludes liability that cannot lawfully be limited or excluded, including liability for fraud, wilful misconduct, or death or personal injury caused by our negligence.
Nothing in these terms makes us responsible for the acts, omissions, statements or compliance of any agent, developer, owner, property seeker or other third party.
40. Data protection and privacy
Our handling of personal information is described in our privacy notice, and our use of storage on your device is described in our cookie notice. Both form part of these terms.
Information you submit in an enquiry may be passed to the developer or agent shown on the listing so they can respond, and is held in the portal’s records for support, quality control and dispute handling.
Partners and owners who receive lead information must handle it as set out in Part D.
41. Changes to these terms
We may update these terms as the portal and the law develop. The version and date at the top of this page show the current version.
Where a change is material, we will take reasonable steps to bring it to your attention, such as a notice on the portal or an email to account holders. Continued use of the portal after a change takes effect means you accept the updated terms. If you do not accept them, stop using the portal.
42. Governing law and disputes
These terms, and any dispute or claim arising out of or in connection with them or the portal, are governed by the laws of the Kingdom of Thailand.
The competent courts of Thailand have jurisdiction, and both you and we submit to that jurisdiction. Before starting proceedings, please raise the issue with us so that we can try to resolve it directly.
43. Other legal points
- Relationship: nothing in these terms creates a partnership, joint venture, agency, franchise or employment relationship between you and us.
- Severability: if a provision is found invalid or unenforceable, the remaining provisions continue in force.
- No waiver: if we do not enforce a provision on one occasion, that is not a waiver of it.
- Assignment: you may not transfer your rights under these terms without our written consent; we may transfer ours, including to a successor of the portal.
- Entire agreement: these terms, with the privacy notice and cookie notice, are the whole agreement between you and us about the portal.
- Third parties: no third party may enforce these terms, except that our group companies and contractors may rely on the limitations and protections in them.
- Language: these terms are published in English. Where a translation is provided, the English version governs if the two differ.
- Headings are for convenience only and do not affect interpretation.
44. Prototype status and legal review
These are working prototype terms for a portal used for private testing. They must be reviewed by a qualified Thai lawyer, and completed with the registered company details, notices address, contact details, retention periods and any regulated-activity disclosures, before the portal is launched publicly.
Nothing on this page is legal advice to you, and nothing in it replaces the advice of your own professional advisers.
Read with these notices
The privacy notice explains how test information is handled, and the cookie notice explains the storage used on your device. Both form part of these terms.
Questions, corrections or removal requests can be raised through the contact page, and partners can find the commercial framework on the partner portal. In the prototype these entries are saved as test records.
